Work Permits and Special Passes for Kenya

Work Permits and Special Passes for Kenya

Employment and Labour

Every foreign national who works or invests in Kenya needs the right immigration status, and every Kenyan employer of a foreign national needs to be able to prove it. The permit system rewards applications that are complete, correctly classed and properly evidenced, and it punishes everything else with time. We act for investors, employers and individual professionals across the permit classes and passes, and we treat immigration as what it is in practice, the critical path of a hiring or an investment, to be managed against the client’s real start date.

What we do

We advise on the correct class before anything is lodged, because the commonest cause of refusal and delay is an application filed in the wrong class or thin on the evidence its class requires. For investors, that is typically the investor permit with its evidence of capital and of the business the investor is establishing. For employees, it is the employment permit with the employer’s justification for hiring a foreign national. We prepare and lodge the application, obtain special passes where work must lawfully begin before the permit issues, secure dependant passes for family, and manage renewals on a diarised calendar so that no one in your business is ever working on an expired status. Where a permit is refused or delayed beyond reason, we pursue review and follow-up with the Directorate.

What you bring

For an investor, the particulars and evidence of the investment and the corporate vehicle behind it. For an employer, the role, the candidate, and the business case for filling the role from abroad. For all applicants, clean personal documentation, which we will list for you precisely at the start so nothing is assembled twice.

Frequently Asked Questions

How long does a Kenyan work permit take?

+

Longer than the official processing estimate, which assumes a perfect application and an uninterrupted system, and that assumption should never be your project plan. We give realistic timelines matter by matter and use special passes to bridge lawful gaps where the work cannot wait.

Can I start work while the permit is pending?

+

Not on the pending application alone. A special pass can authorise work for a limited period while the permit is processed, and obtaining it is a standard part of our engagement where timing is tight.

What about my spouse and children?

+

Dependant passes cover family members, and we lodge them alongside the principal application so the family’s status resolves together.
